The following terms and conditions apply to all transactions on and off this website. The placing of an order indicates your acceptance of these terms and conditions. Please read them carefully and print a copy for future reference. These terms and conditions do not affect your statutory rights. We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.
Copyright Information
All the wedding invitation designs on our website are protected by copyright law. They may not be reproduced or distributed without written permission from Cherries Black Ltd. To enforce the copyright law we place the copyright symbol with our name and contact details at the back of each card.
Accuracy of content
We have taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at the time of publishing and that all goods have been fairly described. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. If the price of the goods increases between the date we accept your order and the delivery date, we will let you know and ask you to confirm by e-mail that the new price is acceptable. If it is not acceptable, then you will of course have the right to cancel your order. Any weights, dimensions and capacities given about the goods are approximate only. To the extent permitted by applicable law, we disclaim all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website and we shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials contained on this website.
Damage to your computer
We make every effort to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website. We will not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.
Availability
All items are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available.
Ordering errors
You are able to correct errors on your order up to the point on which you click on "submit" during the ordering process.
Payment terms
For bespoke or personalised invitations, unless otherwise agreed in writing by us, all customers that have not submitted a credit application and been approved by our accounts department will be required to pay a non-refundable deposit of 50% of the cost before work can begin and all subsequent balances due are payable upon artwork approval. All credit accounts shall be paid up on or before the 30th day after the date of the invoice. We reserve the right without notice to charge interest on past due balances at the rate of 12% per day. We reserve the right to refuse completion or delivery of work until past due balances are paid. The Customer shall pay the Company’s costs, charges and expenses directly or indirectly incurred in obtaining or otherwise enforcing payment of outstanding accounts.
For sample invitations and other non-customised goods full payment is to be made in advance. All prices are inclusive VAT.
Rights of ownership
According to copyright law, the rights to all design and artwork, including but not limited to photography, music and or illustration created by independent photographers, artists or illustrators retained by us, or purchased from a stock agency on behalf of the customer, remain with the individual designer, artist, photographer or illustrator. Unless a purchase of “All Rights” (a Buyout) is negotiated on behalf of us, you may not use or reproduce the design, work or the property therein for a purpose other than the one(s) originally stipulated. If you wish to use the design we have created and/or the images within it for another purpose or project, including a reprint or exhibition, you must contact us to arrange the transfer of rights and the payment of any additional fees before proceeding. Master artwork including roughs, visuals, mock-ups and presentations is our property and will not be released or copied for the client or any third party to use in any way whatsoever without prior written agreement by a director of our company. We reserve the right to photograph and/or distribute or publish for our firm’s promotional and marketing needs any work we create for you, including roughs, visuals, mock-ups and presentations, as samples for our portfolio, newsletter, brochures, presentations and website and for entry for awards. We will endeavour to store files on computer disks for a period of 6 months beyond the delivery of a job. Thereupon, we reserve the right to discard them without notice.
Despatch from Premises
We aim to get the goods to you as quickly as possible. We aim to despatch all non-customised goods in 7 working days. Customised / Personalised goods need at least 2 working days for initial e-drafts to be sent, 1 working day for any changes to be made and 15 working days, upon approval of artwork, until they are despatched from our premises. Goods ordered under our Express Service normally take half the time stated. However, the build-up before the wedding season starts early in March and despatch times can get longer. We will aim to post any delays on our Homepage.
If you require a "non-stock" (eg. bespoke invitations) we recommend that under normal circumstances you allow three or four weeks from approval of artwork for production and delivery. With times rising during the wedding rush period.
Delivery
We use the most cost effective service (according to weight/urgency). Parcels under 4.5kg are normally sent using the daily first class postage system. Parcels over 4.5kg are sent via DHL with the guaranteed 1-2 working days service from the date of despatch. If you have an urgency for the order please state this at the time of order.
For parcels ordered under our Express Service we may use the DHL guaranteed 1 working day service (or pre noon/pre 10am services, if operated in your area). Please note that all parcels are sent sign on delivery and will not be left without a signature. If you wish the parcel to be left it can be at your own risk and the responsibility of the parcel if it gets lost is then yours. Alternatively clients can arrange their own carrier to collect parcels from us.
Acknowledgement and acceptance of your order
You will need to provide us with your e-mail address and we will notify you by e-mail as soon as possible to confirm receipt of your order. An acceptance of your order will take place on us despatching the goods ordered.
Cancellation rights
Under the Distance Selling Regulations you have the legal right to cancel your order within seven days of receipt of your goods (with the exception of any customised / personalised / bespoke items).
Returns Policy
If you are not satisfied with an item you have purchased from us please return it to us in it's original condition and we shall exchange the goods for new items or other new goods of equivalent value (we regret delivery costs cannot be refunded). Items must be returned within 14 days of purchase. Personalised / Customised items or items which have been made to order cannot be returned. For sample invitation cards the cost is refunded if and only if an order for invitation cards is placed with us AND samples are returned to us in the same condition as they were sent.
Misprints & Quality
It is the customers responsibility to ensure that the approved order (including e-proof, chosen ink style and color) is to the customers full satisfaction and has no flaws (spelling mistakes, alignment, centering, spacing etc) before the order goes to print. In the unlikely case a printing error does occur or re-prints are required through no fault of the customer, a free re-print will be offered which will take at least 10 working days to produce (do allow ample time for such eventuality) - no refund or part refund will be offered. Reprints may vary from original prints in colour and shades as they are run on seperate print runs. Reprints will be negotiated on a per order basis.
Our cards are manufactured in India. We strive to get a high standard of quality cards for you, however as quality measures in India are not as stringent as they are in the UK we will not be held responsibe for the cards not being of the best quality. Due to the nature of the manufacturing processes in India it is difficult for us to get the quality of the cards to be impeccable. This is reflected in the prices you pay for our cards.
Due to variations in monitors, the colours and images may differ slightly on screen to that of the finished product. Although the greatest care is taken to ensure the colours / styles / materials / fabrics chosen are delivered, we accept no responsibility for slight variations as this is an inherent feature of custom / handmade stationery. Stationery can not be refunded or returned because of these variations. We take pride in the quality of our work and assure you that we strive to achieve a high standard in quality for the wedding stationery you have ordered.
Limitation of liability
Save in respect of personal injury or death due to any negligence, we shall not be liable to the buyer in respect of any loss suffered by the buyer due to any defect in the goods.
We shall not be liable to the buyer or any third party for any loss of profit, consequential or other economic loss suffered by the buyer arising in any way from this Agreement.
Exclusion of liability
Any disclaimers and exclusions of liability in these terms and conditions shall not apply to any damages arising from death or personal injury caused by our negligence. These disclaimers and exclusions shall be governed by and construed in accordance with English law. If any provisions of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
Set off and counterclaim
The buyer may not withhold payment of any invoice or other amount due to us by reason of any right of set-off or counterclaim which the buyer may have or allege to have or for any reason whatsoever.
Changes to legal notices
We reserve the right to change these terms and conditions from time to time and you should look through them as often as possible.
Force majeure
We shall not be liable for any default due to any circumstance beyond our reasonable control including, but not limited to, Acts of God, war, civil unrest, riot, strike, lock-out, acts of civil or military authorities, fire, flood, earthquake or shortage of supply.
Law, jurisdiction and language
This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.
